Daniel A. Cohen’s practice encompasses decades of experience working with educational institutions and their athletics departments. A dynamic and well-respected lawyer, Dan guides educational institutions through complex Title IX and NIL matters, navigating universities through the intricate landscape of athletics compliance to help them remain in front of the rapidly evolving legal environment.
Dan counsels universities, colleges and other educational institutions on Title IX athletics and sexual misconduct matters, athletics strategic planning, name, image, and likeness (NIL) compliance, litigation, sports law, labor and employment, NCAA compliance, school and university law, and the Family Educational Rights and Privacy Act (FERPA). Viewing legal risks from all angles, Dan has built comprehensive, legally-compliant House implementation structures for 10 schools in FBS conferences over the last year.
With more than 30 years in college athletics, counting his time working in four athletics departments, Dan's Title IX practice is extensive. He performs athletics audits and compliance reviews, develops strategic planning initiatives, and represents schools in investigations, litigation, and appeals.
Notably, Dan maintains an active NIL practice, including drafting NIL contracts and policies for college athletics departments, advising universities on legal and equitable aspects of House and NIL programs, and representing Division I institutions in NIL litigation.
In Title IX sexual misconduct matters, Dan drafts policies and procedures, leads extensive sexual misconduct investigation and adjudication trainings, and conducts investigations. He also litigates Title IX athletics and sexual misconduct matters on behalf of schools, including defending colleges against class actions and investigations by the federal Office for Civil Rights.
Dan has been appointed as a Special Assistant Attorney General by two states to represent their public universities in Title IX matters. Since 2019, he has represented universities in every Football Bowl Subdivision (FBS) conference, as well as college athletics departments across 37 states and Washington, D.C., including major research institutions in 28 of those states.
Dan is a frequent industry speaker, giving presentations to the National Association of Collegiate Directors of Athletics (NACDA), the National Association of College and University Attorneys (NACUA), LEAD1, the National Association for Athletics Compliance, the College Athletic Business Management Association, Women Leaders in Sports, and various collegiate athletic conferences. He has also led Title IX sexual misconduct trainings for multiple state college systems and individual schools.
