Josh’s diverse experience in patent, trademark, false advertising and trade secret litigation includes day-to-day management of pre-suit investigations, trials, settlement negotiations, arbitration, and appeals before the U.S. Patent and Trademark Office (USPTO) and federal courts.
With strength in preparing witnesses for deposition and trial, Josh guides clients through each phase of litigation. His experience includes serving as first-chair trial counsel in bet-the-company patent litigation and representing patent owners in inter partes review (IPR) proceedings. He also handles both business-to-business and consumer class action advertising disputes.
Augmenting his litigation practice, Josh drafts trademark licenses and assignments, prosecutes and enforces trademark portfolios, and advises on IP issues in M&A, equity and debt transactions. He leverages experience gained from spending a year working on-site at a Fortune 1000 client counseling them on advertising compliance and substantiation and Federal Trade Commission (FTC)-related trademark issues and restructuring their advertising compliance processes.
