Barnes & Thornburg’s Energy, Telecommunications and Utilities Practice Group has been involved in every Indiana appellate decision defining the scope of local zoning regulation over public utilities.
Our work dates back to the original decision addressing the issue, Graham Farms v. Indianapolis Power & Light Company, 249 Ind. 498, 233 N.E.2d 656 up through the most recent, Howell v. Indiana-American Water Company, Inc. 668 N.E.2d 1272, and every decision issued in the interim. As a result, we routinely advise clients regarding the scope of zoning jurisdiction over utilities.
