- Customs, tariffs and import compliance – Advising on strategies for navigating special tariffs, tariff classification and duty rates, customs valuation, and preferential trade programs/trade agreements. Representing clients in prior disclosures, enforcement actions, customs audits, and investigations before U.S. Customs and Border Protection (CBP) and Department of Homeland Security Investigations (HSI), as well as qui tam actions under the False Claim Act involving the Department of Justice (DOJ).
- Export controls and economic sanctions – Counseling clients on export licensing requirements in cross-border transactions, M&A due diligence and regulatory filings, and foreign national interactions (“deemed exports”). Advising clients on processes to prevent transactions with countries and parties subject to sanctions administered by the Office of Foreign Assets Control (OFAC). Conducting compliance audits, internal investigations, and voluntary disclosures under the International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR). Assisting with the formulation and implementation of effective compliance programs.
- CFIUS and foreign investment reviews – Advising on national security reviews of foreign inbound investments by the Committee on Foreign Investment in the United States (CFIUS), and outbound investment restrictions enforced by the U.S. Treasury Department. Assisting with due diligence and regulatory approvals.
- Trade remedies and dispute resolution – Representing domestic and foreign producers, exporters, and importers in antidumping and countervailing duty (AD/CVD) investigations before the U.S. Department of Commerce and the USITC. Advising on compliance with AD/CVD orders. Assisting with scope determinations and regulatory advocacy before U.S. trade agencies. Representing clients in Section 337 investigations before the USITC involving imported goods alleged to infringe on U.S. patents and trademarks.
- Trade litigation – Representing clients in international trade matters before U.S. courts, including the U.S. Court of International Trade and the Court of Appeals for the Federal Circuit. Experience includes involvement in the landmark U.S. v. Eurodif S.A. case before the U.S. Supreme Court.
- Trade legislation and policy – Advising industry coalitions, trade associations, and foreign governments on trade policy, legislative strategy, and regulatory compliance. Engaging with U.S. officials, and Congress to shape policy, draft legislation, and advocate for client interests.
- Foreign Trade Zones (FTZs) – Assisting businesses in leveraging FTZs to improve supply chain efficiency and manage customs duty liability. Advising on applications, inventory control, and customs documentation while addressing regulatory challenges and opposition to complex applications.
